1. Nature of Service & Intermediary Status

1. SmsBuyz operates solely as a technology intermediary that facilitates access to virtual phone numbers provided by independent third-party telecommunications operators. SmsBuyz does not own, operate, or control the underlying telephony infrastructure.
2. Virtual numbers are provided on a temporary, one-time-use basis for the sole purpose of receiving SMS verification codes from online services. SmsBuyz makes no guarantee regarding the availability, deliverability, or compatibility of any particular number with any particular service.
3. SmsBuyz acts as a reseller and aggregator. The Company is not a telecommunications provider and bears no responsibility for the actions, omissions, or service quality of the upstream operators.

2. Prohibited Uses & Legal Compliance

1. You shall not use the Service for any unlawful, fraudulent, or malicious purpose, including but not limited to:
   • Identity theft, impersonation, or creating accounts under false pretenses;
   • Financial fraud, money laundering, or terrorist financing;
   • Circumventing sanctions, embargoes, or export controls;
   • Harassment, threats, stalking, or any form of abuse directed at individuals;
   • Distribution of spam, phishing, malware, or other harmful content;
   • Any activity that violates applicable local, national, or international law.
2. It is prohibited to use the Service to register or operate paid subscription services, premium-rate services, or any service that causes unauthorized charges to third parties.
3. You are solely responsible for ensuring that your use of the Service complies with all applicable laws in your jurisdiction. SmsBuyz does not provide legal advice and cannot determine the legality of your specific use case.

3. Data Collection, Retention & Law Enforcement Disclosure

1. SmsBuyz collects and retains the following data for each user account: email address, IP addresses used during registration and login, browser fingerprint data, transaction history, and order records including phone numbers issued and timestamps.
2. Upon receipt of a lawful request from a court, law enforcement agency, regulatory authority, or other competent governmental body, SmsBuyz will disclose any and all relevant user data, including but not limited to: IP addresses, account information, purchase history, phone numbers obtained, timestamps, payment records, and any other data held on the account.
3. SmsBuyz may proactively report suspicious activity to law enforcement authorities without prior notice to the user if, in SmsBuyz's sole judgment, such activity may constitute a criminal offense or pose a risk to public safety.
4. By using the Service, you acknowledge and consent to such data collection and potential disclosure. If you do not agree, you must immediately cease using the Service.

4. Payments, Refunds & Balance

1. Payment for any service is debited immediately upon purchase of a phone number.
2. A refund is issued automatically if you cancel the order before receiving an SMS. In cases where no SMS arrives within the allotted time, the order expires and your balance is restored. Abuse of this mechanism (e.g., systematic cancellations) may result in account restrictions.
3. The fee of payment systems upon depositing funds to the electronic balance is indicated in the "Top up balance" section or when going to the payment system page.
4. Transferring balance between accounts is prohibited. Your account will be deleted if unused for more than one (1) year; the remaining balance is not refundable.

5. Service Usage Rules

1. Each purchased phone number may only be used to receive SMS from the selected service. All other SMS sent to that number from different services will be discarded.
2. In case of mass cancellations or abuse of the number allocation system, restrictions will be imposed on your account.
3. The purpose of the Service is to provide a virtual number and deliver the SMS content. SmsBuyz is not responsible for any bans, suspensions, or restrictions imposed by third-party services on accounts registered using these numbers. If you are not satisfied with a number, press the "Cancel" button before receiving an SMS.

6. Limitation of Liability

1. The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
2. SmsBuyz shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to: loss of profits, data, or business opportunities; account bans imposed by third-party services; or service interruptions.
3. SmsBuyz is not responsible for incorrect use of API functions or for software bugs caused by the user's implementation. No refund is provided for errors attributable to user-side software.
4. Total aggregate liability of SmsBuyz to any user shall not exceed the amount paid by that user during the thirty (30) days preceding the claim.

7. Account Security

1. Username, password, API key, and any linked Google account credentials are considered the Customer's personal authentication credentials. The Customer is solely responsible for maintaining the confidentiality and security of these credentials.
2. You must notify SmsBuyz immediately of any unauthorized access to or use of your account. SmsBuyz will not be liable for any loss or damage arising from your failure to comply with this obligation.

8. Termination & Suspension

1. SmsBuyz reserves the right to suspend, restrict, or terminate any account at any time, with or without prior notice, for any reason including but not limited to: violation of these Terms, suspected fraudulent or illegal activity, or upon request of a law enforcement authority.
2. Upon termination for cause, no refund of the remaining balance will be provided. SmsBuyz may retain user data as required by applicable law or as necessary to cooperate with law enforcement investigations.

9. Indemnification

1. You agree to indemnify, defend, and hold harmless SmsBuyz, its officers, employees, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with: your use of the Service, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

10. Eligibility & Age Requirement

1. You must be at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is greater) to create an account and use the Service.
2. By registering, you represent and warrant that you meet this age requirement. SmsBuyz reserves the right to request proof of age and to terminate any account found to belong to a person under the minimum age.

11. Force Majeure

1. SmsBuyz shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond SmsBuyz's reasonable control, including but not limited to: natural disasters, war, terrorism, riots, government actions, embargoes, power outages, telecommunications or internet failures, cyberattacks, or actions of third-party service providers.

12. Modifications

1. SmsBuyz reserves the right to modify these Terms at any time. Changes become effective upon posting to this page. Continued use of the Service after any modification constitutes acceptance of the revised Terms.
2. It is your responsibility to review these Terms periodically for changes.

13. Governing Law & Dispute Resolution

1. These Terms shall be governed by and construed in accordance with applicable international commercial law. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to the competent courts of the jurisdiction in which SmsBuyz is incorporated.
